Exemption: Content Produced by Third Parties

hardxxxpics.com is not a "producer" (primary or secondary) of any visual matter depicting real or simulated sexual behavior, explicit or otherwise, offered on the website. With respect to such, the operators confine their undertakings to the transmission, storage, retrieval, hosting and/or formatting of the content furnished by third-party users. All parts of hardxxxpics.com on which user-furnished content appears are under the relevant user's control. The operators of hardxxxpics.com are therefore free from compliance with Section 2257 records keeping and labeling obligations as described in 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may delete any images or videos if such are determined, at the sole discretion of the operator, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.

Exemption: Content Produced by Website Operator

All other visual depictions displayed on the website are excluded from compliance with the provisions of 18 USC 2257 Statement and 28 C.F.R. 75 because said visual depictions do not consist of depictions of conduct as specifically defined in 18 USC 2257 Statement (2) (A) through (D), but are merely depictions of non-sexually explicit nudity, or are depictions of simulated sexual conduct, or are otherwise excluded because the visual depictions were created prior to July 3, 1995.
